This book is a derivative of the author’s thesis that was originally submitted in partial fulfillment of the requirements for the award of a degree of Master of Laws of Makerere University. The broad objective of the study was to examine the causes of case backlog in the Judiciary and its implications on the right to due process in Uganda. The specific objectives were to investigate why case backlog is steadily increasing in the Judiciary; to evaluate the effects of case backlog on the right to due process and to explore and recommend urgent interventions to alleviate the problem. The author then acknowledged that across the world, the right to a fair trial has been the subject of interpretation and adjudication than most of the other rights. The Judiciary in any given democratic state is the body mandated to interpret the law, and to ensure that citizens benefit from due process. Unfortunately every Judiciary in the world is bogged down with the menace of case backlog. The study investigated the concept of case backlog and its impact on the right to due process and advanced different strategies in mitigation. On top of preserving elements of the original content, this expanded edition of the book highlights the different developments that have transpired since the thesis was submitted in 2012. It reflects new information arising from the recommendations made in the master’s thesis and the gaps thereof. This book is restructured from its original academic approach to a less scholarly approach that appeals to all readers that are curious to learn about Uganda’s Judicial system and particularly about the case backlog situation, which remains one of the most excruciating thorn in the Judiciary’s feet.
